If your Device is location-enabled, the quality of the embedded cellular signal, as well as your ability to locate a missing pet, may be affected by your location and may limit FitBark’s ability to deliver the Service. FitBark cannot provide location tracking services when the Device is not within range of a site used to provide the location tracking service.

The Service provides an approximate location of the requested Device and does not provide guaranteed results. Even within your Device’s coverage area, there are several factors including, without limitation, the network capacity, limitations and restrictions of wireless carrier service providers, your Device type, terrain, proximity to buildings and foliage, and weather that may impact the availability and the quality of the Service. The results you obtain from the location tracking service including, without limitation, maps, directions or requested locations, may not be accurate, timely or reliable.

FitBark neither guarantees that a lost pet will be found, nor provides a recovery or search service for your pet. You acknowledge and accept these limitations of the Service, and that FitBark will not be liable to you or to any third party in the event that the Service is inaccessible or malfunctions. The Service is only intended for tracking pets and should not be used for tracking physical objects, humans, or other animal species.

Content through the Service is for informational purposes only and is not intended to replace the relationship between you and your veterinarian or other medical providers. We are not a licensed veterinary provider and have no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of any specific exercise on a medical condition that your dog may have. You should always consult a veterinarian before starting a fitness program, changing your diet or if you have any questions regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on or through the Service.

You should understand that when your pet participates in any exercise or exercise program, there is the possibility of animal or human physical injury and/or death. If you think you may have a medical emergency, call your veterinarian immediately. Pets who are prone to ingesting or chewing physical objects should not use the Service unless such use is directed and closely monitored by a veterinarian. By using the Service, you represent that you have received consent from your veterinarian to participate in the Service.

We are not responsible for any health problems that you or your dog may develop resulting from training programs, products, or events you learn about through the Service. If you or your dog engage in an exercise program you receive or learn about through the Service, you agree that you do so at your own risk and are voluntarily participating in these activities.

Any contests, sweepstakes or other promotions (collectively, “Promotions”) made available through the Service may be governed by rules that are separate from these Terms and Conditions. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.

Our Service may contain links to third-party websites or services that are not owned or controlled by FitBark.

FitBark has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

You acknowledge and agree that FitBark shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third-party websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third party websites or services that you visit.

If FitBark Inc. is involved in a merger, acquisition or asset sale, your Personal Information may be transferred as a business asset to a new company. In such cases, we will provide notice before your Personal Information is transferred and/or becomes subject to a different Privacy Policy.

In the event of any conflict, contradiction, or ambiguity between the Terms and Conditions of the FitBark Service and its documents incorporated by reference, the terms set forth in the documents incorporated by reference will apply.
